Our Commitment to Compliance: Phat Panda is committed to operating at the highest standard of regulatory compliance in the hemp industry. Compliance is not an afterthought — it is foundational to everything we do, from sourcing and manufacturing to lab testing, labeling, and shipping. We believe that transparency and rigorous adherence to federal and state regulations are essential to earning and maintaining the trust of our customers, partners, and regulators.
2018 Farm Bill (Agriculture Improvement Act): All Phat Panda products are derived from hemp as legally defined by the Agriculture Improvement Act of 2018, codified at 7 U.S.C. § 1639o. Under this law, "hemp" means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, with a Delta-9 tetrahydrocannabinol (THC) concentration of not more than 0.3 percent on a dry weight basis. The 2018 Farm Bill removed hemp from the definition of "marijuana" under the Controlled Substances Act, making hemp and hemp-derived products with compliant THC levels federally legal. Every Phat Panda product is manufactured, tested, and verified to contain less than 0.3% Delta-9 THC by dry weight in full compliance with this federal standard.
DEA Interim Final Rule: Consistent with the Drug Enforcement Administration's (DEA) Interim Final Rule published on August 21, 2020, all Phat Panda products are derived from hemp and contain Delta-9 THC concentrations that do not exceed the 0.3% threshold on a dry weight basis. Products meeting this standard are not controlled substances under federal law. We maintain documentation and testing records to verify compliance with DEA requirements.
Third-Party Lab Testing: Every batch of every Phat Panda product is tested by independent, third-party laboratories that hold ISO/IEC 17025 accreditation — the international standard for testing and calibration laboratory competence. We never rely on in-house testing alone. Certificates of Analysis (COAs) are available on each product page on our website. A COA is an official document issued by the testing laboratory that details the specific cannabinoid profile and safety test results for a given product batch. Each COA includes the laboratory name and accreditation information, the date of testing, the batch or lot number tested, cannabinoid potency results, and pass/fail results for all safety screenings.
What We Test For: Our comprehensive testing panel covers six critical areas. Cannabinoid Potency Analysis includes Delta-9 THC, THCA, Delta-8 THC, CBD, CBDA, CBG, CBGA, CBN, and CBC — ensuring accurate labeling and federal THC compliance. Pesticide Screening covers a panel of 400+ pesticide analytes, including commonly used agricultural chemicals, to ensure our products are free of harmful pesticide residues. Heavy Metals Testing screens for lead (Pb), arsenic (As), cadmium (Cd), and mercury (Hg) at parts-per-billion sensitivity, in compliance with established safety thresholds. Microbial Contamination Testing screens for harmful microorganisms including E. coli, Salmonella, total yeast and mold count, and other pathogenic bacteria. Mycotoxin Screening tests for aflatoxins (B1, B2, G1, G2) and ochratoxin A — toxic compounds produced by certain molds that can contaminate agricultural products. Residual Solvent Analysis tests for residual processing solvents (such as butane, propane, ethanol, and others) to ensure extraction and manufacturing processes meet safety standards.
Manufacturing & Quality Standards: Phat Panda products are manufactured in facilities that follow current Good Manufacturing Practices (cGMP) as outlined by the FDA for dietary supplements and food products. Our quality program includes documented Standard Operating Procedures (SOPs) for all manufacturing processes, batch-level tracking from raw material receipt through finished product, in-process quality checks at critical control points, finished product quarantine and release protocols pending lab test results, regular facility audits and sanitation programs, and employee training on quality, safety, and compliance procedures.
Product Labeling: We are committed to accurate and transparent product labeling. Every Phat Panda product label includes the product name and description, cannabinoid content (including Delta-9 THC and CBD concentrations), a complete ingredient list, net weight or volume, the batch or lot number for traceability, a QR code linking directly to the product's COA, required legal disclaimers and warnings, the manufacturer name and contact information, and suggested use directions where applicable. Our labeling practices are designed to comply with FD&C Act requirements and applicable state labeling regulations for hemp products.
Supply Chain Transparency: Phat Panda sources hemp exclusively from licensed U.S. hemp farms operating under approved state or tribal hemp programs, or under USDA-licensed hemp production plans. We maintain seed-to-sale traceability throughout our supply chain, meaning we can trace every product back to the specific farm, harvest, and processing batch from which it originated. Our supply chain partners are vetted for compliance with applicable agricultural regulations, and we require current Certificates of Analysis for all raw hemp materials we receive.
State Compliance Program: While hemp is federally legal under the 2018 Farm Bill, individual states maintain their own regulations regarding the sale, possession, and shipment of hemp-derived products. Phat Panda operates an active state compliance monitoring program that includes regular review of state hemp laws and regulatory updates by our compliance team, product category restrictions by state (certain states prohibit smokable hemp, specific cannabinoids, or certain product formats), automated shipping restrictions that prevent orders of non-compliant products to restricted states, and proactive customer communication when state regulations affect order fulfillment. We strongly encourage customers to familiarize themselves with the hemp laws in their state and local jurisdiction before placing an order.
PACT Act & Shipping Compliance: Phat Panda complies with all applicable federal shipping regulations for hemp products, including voluntary compliance with the Prevent All Cigarette Trafficking (PACT) Act for all smokable and vaporizable hemp products. Our shipping compliance program includes age verification at the point of sale and at delivery, use of carriers that support age-verified delivery services, proper documentation and record-keeping for all shipments, and discreet packaging that meets carrier requirements while protecting customer privacy. Age Verification Program: Phat Panda requires all customers to be at least 21 years of age. While some jurisdictions set the hemp purchasing age at 18, we have adopted a 21+ standard across all states as a reflection of our commitment to responsible commerce and consumer safety. Our age verification is enforced at multiple points: an age gate upon entry to our website, age confirmation at the time of checkout, and carrier-verified age confirmation at the time of delivery (government-issued photo ID may be required). We do not market to, advertise to, or knowingly sell products to anyone under the age of 21.

Please include the product name and batch/lot number, a description of the adverse event, the date and time of occurrence, and any relevant medical information you are comfortable sharing. We investigate all reported adverse events and, where appropriate, report them to the FDA's MedWatch Safety Reporting Program and relevant state authorities.
